A Criminal Writ Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the Petitioner seeking quashing of FIR No.174/2020 dated 20.11.2020 under Sections 468/471/420/511 IPC registered at Police Station Parliament Street, New Delhi.

It is submitted that the FIR can be registered on a Complaint only if it discloses a cognizable offence. The Complaint mentions about one unsigned, undated fabricated and fake document was received by which the so called nomination of someone by the name of Ms. Vartika Singh Pratapgarh, as a Member of National Commission of Women (NCW) was to be given from Ministry of Women and Child Development, Government of India to the Manager of Govt. of India, Press, Mayapuri, New Delhi for issuing Gazette Notification in that regard. under Section 420/471/468/511 IPC was registered. It is submitted that reading of the said Complaint does not disclose any offence whatsoever. On this short reason the FIR is liable to be quashed. 3.
The Status Report has been filed on behalf of the State, wherein it is explained that on the Complaint dated 20.11.2020 of V.C. Chaoudhary, Under Secretary (General Admin), Ministry of Women & Child Development, Govt. of India, the present FIR No.174/2020 was registered. During the course of the investigation, IO SI Raj Kiran examined Vartika Singh who disclosed that on 12.04.2020 she had received a WhatsApp message from an unknown number 965107000 which was later identified to be that of Dr. Rajneesh Kumar Singh (Petitioner). 4.
The Petitioner had introduced himself as Advisory Member of Central Food Corporation and told her that he would talk to the Hon‟ble Minister of Women and Child Development for her nomination as member of NCW. 5.
She further disclosed that the alleged letter through which she was nominated as member of NCW, was sent to her by the Petitioner. She further stated that Rs.25 lakhs were demanded from her for her nomination, which she refused to give. Thereafter, she was not appointed as Member, NCW.

Some documents were produced by Ms. Vartika Singh along with her phone which contains screenshots of the WhatApp chat sent to her by the Petitioner. The mobile phone of Vertika Singh containing forged letter, which was sent by the Petitioner to her, was recovered. The phone was forwarded to FSL for which the result is awaited. 7.
Thereafter, the Petitioner moved an Anticipatory Bail Application which was dismissed by the Court of learned M.M on 02.07.2021 and by The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
learned Sessions Judge on 28.03.2024. The Petitioner moved an Anticipatory Bail Application before this Court and thereafter, he joined the investigations. He disclosed that one Vijay Gupta had sent him the alleged forged letter, which he had forwarded to Vartika Singh through WhatsApp from his mobile phone. He further disclosed that the original forged letter is in possession of Vijay Gupta. He was granted Bail by this Court on 13.08.2024.

The mobile phone of the Petitioner was seized and has been forwarded to FSL, Rohini for expert opinion. The role of Petitioner is being ascertained and another co-accused Vijay Gupta is yet to be interrogated and the entire conspiracy is to be unearthed. The origin of the forged letter is yet to be ascertained and the forged letter is yet to be recovered. 9.
Learned ASC for the State further states that Vijay Gupta has now been examined and his mobile phone has also been seized. The investigations are still ongoing.

The only grievance of the Petitioner is that the Complaint in the first instance did not disclose any cognizable offence and, therefore, the FIR could not have been registered. However, there are specific averments made in the Complaint from where the offence of an attempt to cheat, is clearly discernable. Furthermore, there were allegations of the Letter being forged. The investigations were mandatorily required to trace out this forged letter in original and also to unearth the conspiracy of how the Letter reached the Complainant. To say that the FIR could not have been registered on the Complaint, is erroneous. There was a prima facie cognizable offence disclosed in the Complaint which resulted in the registration of FIR. investigations have revealed the specific role of the Petitioner. 11.
There is no ground for quashing of the FIR. The Petition is hereby, dismissed.

The Petition stands disposed of accordingly along with the pending Application(s).
