Counsel for the Petitioner states that he is not in communication with his client. He submits that as per his information, the parties have been granted divorce by way of a decree passed by the Additional Principal Judge, Family Court, Budaun, U.P.

In light of the above, the instant proceedings which pertain to an interim order passed in proceedings under Section 125 of the Code of Criminal procedure, 19731, have therefore, lost their relevance since the parties have been divorced. Moreover, it must be noted that none of the parties are present before the Court. In fact, Respondent No. 1 (representing herself and her minor son - Respondent No. 2) has not appeared in the present proceedings since 8th August, 2019, when she was directed to approach the Delhi High Court Legal Service Committee (DHCLSC) to 1 "Cr.P.C."

avail the legal aid services. There is only one appearance noted in the order dated 8th May, 2024, that too of a proxy counsel, on behalf of Respondent No. 2 (minor son of the Petitioner and Respondent No. 1), when the matter was taken up and fresh notice was directed to be issued to Respondent No.
1. Thus, this appearance seems to be an erroneous recording of appearance. 3.
In light of the foregoing, in absence of any communication or instructions being received by Counsel for the Petitioner, the instant petition is dismissed for non-prosecution. Pending application is accordingly disposed of.
