On last two consecutive dates none appeared for petitioner and same is the status today as well, even in this post lunch session. The matter is being repeatedly adjourned for consideration of maintainability of this writ petition. The petitioner filed an appeal under Section 9 of the Public Premises (Eviction of Unauthorised Occupants) Act, but the same dealt with cancellation of allotment. The order under Section 5 of the Act (pdf page 73) has not been challenged through appeal till date, so maintainability of this petition remains contentious.

Since today for the third consecutive date none has appeared for petitioner, the petition as well as pending application are dismissed in default.
