Writ Petition under Article 226 of Constitution of India read with Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of FIR No. 0573/2023 registered under Sections 420/468/471 IPC at P.S. Dwarka South and all the proceedings emanating therefrom in terms of the Settlement dated 13.12.2024.

The parties are present in the Court and are identified by their respective Counsel and the Investigating Officer. 3.

The Respondent No. 2 submits that he is the owner of the property in dispute in respect of which the Petitioner has filed the Civil Suit in which, he is claiming himself to be the owner on the basis of some documents, which are forged and fabricated. where it has been amicably settled and the Petitioner has withdrawn his Suit. 4.

The parties have endorsed the amicable Settlement dated 13.12.2024 and accepted the terms thereof voluntarily and they submit that the said Settlement has been arrived at between the parties, without any pressure and coercion and that they shall remain bound by the terms of the settlement. 5.

In view of statement of both the parties and the fact that the parties have amicably resolved their dispute out of their own free will and without any coercion, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, considering the totality of circumstances and the fact that they have settled the matter vide Settlement dated 13.12.2024, the FIR No. 0573/2023 registered under Sections 420/468/471 IPC at P.S. Dwarka South and all the consequential proceedings emanating therefrom, are hereby quashed.
