Petition under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') On advance Notice, learned ASC has appeared and accepts the Notice on behalf of the State.

Brief facts of the case are that the parties are known to each other. The Respondent No. 2/Complainant works as a water filter. On 20.06.2023 at around 4:00 p.m., he went for a walk in the Park near Gagan Cinema. Thereafter, two boys, Gaurav and Tarun came and had a fight with them once before, which was settled at that time. Tarun abused him and hold his hands and Gaurav hit him on the head with a sharp iron object from behind due to which, he fell on the ground. After that, Gaurav and Tarun hit him with kicks and punches due to which, blood started flowing from the Complainant's head. Thereafter, both the Accused ran away. The record shows that the injury suffered by the Complainant, was simple in nature. 7.
On the Complaint of the Respondent No.2/Complainant, FIR No.424/2023 dated 20.06.2023 under Section 308/34 IPC, got registered at Police Station Nand Nagri, Delhi.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 08.05.2023. 9.
Today, the Respondent No. 2, who is present in the Court, states that he has no objection if the FIR is quashed.

The Statement of the parties have already been recorded before the learned Joint Registrar. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No.424/2023 dated 20.06.2023 under Section 308/34 IPC, registered at Police Station Nand Nagri, Delhi and all the consequential proceedings emanating therefrom are quashed, 12.
