The present petition under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita (formerly Section 482 of the Criminal Procedure Code) seeks grant of parole for a period of two months. The Petitioner has been convicted in the proceedings arising from FIR No. 532/2021 for the offences under Sections 392/34/397 of the Indian Penal Code, 1860 and Sections 25/27 of the Arms Act, 1959 registered at P.S. Kalyanpuri. The Petitioner is currently serving his sentence of rigorous imprisonment for 7 years in Central Jail No. 13, Mandoli.

23rd December, 2024, rendered by this Court in Criminal Appeal No. 717/2024, upholding the Petitioner's conviction in the aforenoted FIR. 3.

The Court has considered the aforenoted contention. The Petitioner was convicted under Sections 397 and 392 of the IPC, and Sections 25/27 of the Arms Act, and has been sentenced to seven years of rigorous imprisonment along with a fine of INR 20,000/-. According to the nominal roll dated 23rd April, 2025, the Petitioner has already spent 3 years, 6 months, and 26 days in custody and has also earned a remission of 3 months and 4 days. Accordingly, the Petitioner has served more than half of the total sentence.

With respect to the four pending cases noted in the nominal roll, the Petitioner has been granted bail in all of them. While his overall conduct has been assessed as unsatisfactory, his conduct in jail over the past year has been satisfactory. Additionally, the Petitioner has faced multiple disciplinary actions for instances of misconduct, and has duly undergone the punishments imposed in each case.

The Court is mindful that the provision of parole is a benevolent one, designed for the welfare of prisoners and to further facilitate the rehabilitation of prisoners and society. Therefore, having regard to the foregoing, as well as the period of custody already undergone by the Petitioner, the Court is inclined to accept the Petitioner's request. 6.

In light of the foregoing facts, the petition is allowed and the Petitioner is directed to be released on parole for a period of four weeks, from the date of his release, on his furnishing a personal bond in the sum of INR 15,000/- with one surety in the like amount to the satisfaction of the concerned Jail Superintendent, subject to the following conditions: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(i) The Petitioner shall report to the concerned SHO(s) once a week on every Monday during the period of parole.

(ii) The Petitioner shall furnish his telephone number to the SHO(s) concerned, which the Petitioner will keep operational at all times. (iii) The Petitioner shall surrender before the Jail Authorities at the expiry of the period of parole.

However, in light of the Petitioner's history of indiscipline and the punishments awarded to him over the years, he is hereby cautioned that any further instances of indiscipline or misconduct, can result in refusal of the privilege of parole.
