The accused/applicant seeks interim bail for 30 days on medical grounds in the case FIR No. 125/2020 of Police Station Preet Vihar for offence under Section 302/307/34 IPC and Section 25/27/29 of the Arms Act.

It is contended on behalf of the accused/applicant that he suffered fracture of thumb and has been advised surgery, so he may be granted interim bail of 30 days for surgery and post operative care. 4.

filed before the Court of Sessions.

It appears from the said Medical Status Report (filed before the Court of Sessions) that the accused/applicant was taken to the DDU Hospital on multiple occasions and is being provided proper medical treatment, for which he was advised surgery but he refused to undergo surgery. 6.

Considering the said Medical Status Report, which was placed on record of this case by the accused/applicant himself in the backdrop of nature of allegations and stage of trial, besides his antecedents as disclosed by the IO/Inspr. Ranbir Singh, I do not find it a fit case to release the accused/applicant on interim bail. The application is dismissed. 7.

However, the Jail Superintendent is directed to ensure best possible medical treatment to the accused/applicant, including surgery if the accused/applicant gives consent for that.

Copy of this order be sent to the concerned Jail Superintendent for information and compliance.
