The present bail application is filed by the applicant seeking interim bail for a period of 03 months in FIR No. 167/2022 dated 09.06.2022 registered at Police Station Rajinder Nagar, Delhi for the offences under Sections 397/34 of the Indian Penal Code, 1860 ('IPC').

The interim bail is sought on the ground that the son of the applicant, who is 2 years and 11 months old is suffering from TCell Acute Lymphoblastic Leukemia and requires urgent medical attention. The applicant is in custody for almost 3 years. 5.

The status report in regard to the medical condition of the son of applicant is taken on record. The medical condition has also been verified by the State.

In view of the above, the present bail application is allowed. However, appropriate conditions ought to be put to allay the apprehension of the applicant tampering with the evidence, threatening the witnesses or evading the trial. 8.
In view of the above, the applicant is directed to be released on interim bail for a period of 02 months on furnishing a personal bond in the sum of ₹20,000/- with one surety of the like amount, subject to the satisfaction of the concerned Jail Superintendent and on the following terms and conditions: a. The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case, in any manner whatsoever; b. The applicant shall under no circumstance leave the boundaries of the country without permission of the learned Trial Court;
c. The applicant shall appear before the learned Trial Court as and when directed;
d. The applicant shall provide the address where he would be residing after his release and shall not change the address without informing the concerned IO/ SHO;
