By way of present petition, filed under Section 482 Cr.P.C., the petitioner seeks to assail the order dated 22.02.2023 whereby his application under Section 91 Cr.P.C. came to be dismissed. 2.

It is the contention of the petitioner that since respondent No.2/complainant has failed to produce the documents in support of its case, thus, necessitating the petitioner to prefer the subject application. He submits that the presently matter is at the state of final arguments. After some arguments, learned counsel, on instructions, seeks leave to withdraw the petition, however, prays that the consequence of non-filing of documents be considered by the Trial Court.

Considering that the matter is at the stage of final arguments, present petition is dismissed as withdrawn.
