Contrary to the last date, today the petitioner/tenant has raised a plea that the use and occupation charges had been paid by him to the erstwhile counsel, who did not deposit the same. Admittedly, the possession of the subject premises stand restored to the respondent/landlord in execution proceedings consequent upon vacation of stay on operation of the impugned eviction order.

At this stage, the petitioner/tenant after consulting his counsel seeks permission to withdraw this petition with liberty to file civil suit for recovery of his articles lying in the subject premises. 3.

Accordingly, the petition as well as pending applications are dismissed as withdrawn with liberty as sought.
