Petitioners seek compromise quashing of an FIR No. 0203/2023 dated 22.07.2023 under Sections 498-A, 406 and 34 OF IPC, registered at P.S. Mohan Garden, Delhi as well as quashing of consequential proceedings arising there from.

The dispute between the parties arose from the matrimonial discord between the Petitioner no.1/ Accused (husband) and Respondent no.2/ Complainant (wife). The couple got married on 28/11/2021 according to the Hindu rites and ceremonies. No child is born out of the wedlock. 2.1 Petitioner no.2 and Petitioner no.3 are the parents of Petitioner 1. Petitioner No. 4 is his sister.

Respondent No. 2, currently residing in Canada, has joined the proceeding through video conferencing. I have interacted with her and she duly states that she is not interested to press any charges against the Petitioners and has amicably settled the dispute. She would submit that, at the relevant time, there were serious disputes between her and Petitioner No. 1 arising out of the matrimonial acrimony. Subsequently, they have buried the hatchet in the larger interest of enjoying the future peace and have also divorced each other. Mother of the Respondent No.2 is also present in person and she supports her daughter in decision taken by her. 4.
In the aforesaid backdrop, I have heard the learned counsel for the Petitioners and the Respondent as well as perused the material available on record.

It transpires that during the pendency of the criminal proceeding, the parties have amicably settled the dispute through an MOU of Mutual Settlement and Dissolution of Marriage dated 25/11/2023 and subsequently, divorce by mutual consent has been granted by a competent Family Court vide decree dated 19/11/2024. As regards to the settlement, the terms thereof have been complied by both sides and there is nothing pending due from either party.

Given that the dispute has been resolved, continuing with criminal proceedings may serve no useful purpose. It would be a drain on judicial resources and abuse of the process of law, especially when dispute does not involve any public interest or interest of the society at large. Continuation of proceedings, on the other hand may result in hostility between the parties and defeat the very purpose of settlement.

In the interest of justice, and exercising the inherent powers vested in this Court under Section 528 of BNSS, it is therefore deemed appropriate to quash the FIR arising from this matrimonial dispute. Reference in this context may be made to judgment rendered in Gian Singh v. State of Punjab & Anr. [(2012) 10 SCC 303]1.

Consequently, the instant petition is allowed. FIR No. 0203/2023 dated 22.07.2023 registered at P.S. Mohan Garden under Sections 498-A, 406 and 34 OF IPC in question and all consequential criminal proceedings arising there from are hereby quashed.
