JUDGMENT

This so called public interest litigation has been preferred with the following prayers:

"i) To pass necessary, order and directions to the respondent no.1 to 4 to look into the serious matter relating to International W.P.(C) 5968/2019 Page 1 of 3

Human Auctioning, bidding and selling through respondent no.5 to 16 in the interest of justice;

ii) to pass necessary order and direction scraping/nullifying and declaring the system of bidding/ auctioning/ selling of International Human in the name of game as illegal, in the interest of justice and to uphold the rule of law; iii) to pass necessary order & direction initiating an enquiry as the Hon'ble Court may deem think fit and proper in the interest of justice and to uphold the rule of law ; iv) to take appropriate action against the guilty persons/offenders (i.e. the respondent no. 5 to 16), in accordance with law for violating the law and undermining the Constitutional provisions, and the law and the legal system; v) to pass such other order or orders that may be deemed fit and proper in the facts and circumstances of the case." 2.

Having heard the counsel for petitioner and looking to the facts of the case, it appears that this is not a public interest litigation at all. This is, in fact, a publicity interest litigation. This is not a case of auctioning of any player, especially in the games, which are pointed out by the counsel for petitioner like cricket or kabbadi. In fact, what is to be appreciated is the sports skills of the candidate or player. There is no question whatsoever arises for the sale or purchase of the human beings. This is nothing but misuse of several terms, for the national players, in this writ petition which is derogatory to our national players. Just to get the publicity of this matter and of the petitioner, these allegations have been levelled against the respondents about their auctioning/selling etc. of the players. Hence, we see no reason to entertain this writ petition.

We are, therefore, dismissing this writ petition with the costs of Rs.25,000/- (Rupees twenty five thousand only). This amount will be W.P.(C) 5968/2019 Page 2 of 3

deposited in the Bank Account No.15530110000359, Registrar General Account, Juvenile Justice Centre SB, UCO Bank, Delhi High Court, New Delhi either by cheque or bank draft, within a period of six weeks from today, towards Juvenile Justice Fund. This amount shall be utilised for the welfare of the juveniles.

A copy of this order will be sent to the Member Secretary, Delhi State Legal Services Authority, Central Office, Patiala House Courts Complex, New Delhi - 110001.
