The Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 of BNSS has been filed on behalf of the Petitioner seeking Quashing of FIR No.453/2017 dated 30.09.2017 under Section 279/338/304A IPC and Section 146/196 MV Act registered at Police Station Dwarka South.

In terms of the Settlement in Lok Adalat vide Order dated 14.12.2024 the Settlement amount was agreed as Rs.21,31,000/- on account of demise of Shri Neeraj aged 18 years in the road accident. 3.

of Rs.20,31,000/- has already been received by the Respondent No.2 and 3, the parents. The balance amount of Rs.1,00,000/- is paid today to the Respondent No.2 and 3 vide two Bank Drafts No."000336" and "000337" of Rs.50,000/- each both dated 29.04.2025 issued by HDFC Bank, Sector 113, Gurgaon, which is accepted by the Respondents towards full and final Settlement of their claims and they have left no grudge or grievance against the Petitioner in any manner whatsoever. Therefore, the Petition be quashed. 4.

The Respondents are present in the Court and submits that the matter stands settled with the Petitioner. The Respondent No.2 and 3 have no objection if the FIR is quashed against the petitioner on account of the settlement already arrived at between the parties. 5.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 6.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 453/2017 dated 30.09.2017 registered at Police Station Dwarka South, for offences punishable under Sections 279/338/304A of the Indian Penal Code, 1860 with all the subsequent proceedings and the charge sheet is hereby quashed qua the Petitioner. 7.
