The petition under Section 528 of BNSS, 2023 has been filed by the petitioners for quashing of the Complaint bearing DD No. 2974 dated 28.08.2024, Police Station Paschim Vihar East, New Delhi and the consequential proceedings emanating therefrom. 2.
Learned counsel appearing on behalf of the petitioner submits that the respondent No. 3 is misusing this Complaint which has been registered with the DD No. 2974 dated 28.08.2024 to seek cancellation of Adoption Deed(s) The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. in respect of the petitioner No. 1 and their daughter in Canada. It is submitted that because of the gross misuse and abuse of this Complaint, quashing of the same has been sought by the petitioners. However, it is now submitted that the petitioners wish to withdraw the present petition with the prayer to direct for expeditious disposal of the DD No. 2974 dated 28.08.2024.

Learned Prosecutor, on instructions from the Investigating Officer submits that the enquiry is still being conducted in DD No. 2974. 4.

Considering the submissions made, the petitioners are permitted to withdraw the present Petition with liberty to pursue their remedy before the appropriate Forum. The respondent/State is directed to conclude the enquiry on the aforesaid DD as expeditiously as possible, preferably within two weeks.

No further directions are required. The petition along with Application(s) are accordingly dismissed as withdrawn with liberty as prayed for.
