Learned counsel for the petitioner submitted that the Investigating Officer (IO) of the case has called the petitioner twice in 10 days and is unnecessarily harassing the petitioner by calling him time and again to join the investigation. Learned counsel for the petitioner further submitted that he will move an application before the Court, which granted anticipatory bail to the petitioner for relaxation of the terms and conditions for appearance before the IO.

Learned APP submitted that the investigation in the matter is still going on and the investigation shall be completed as soon as the FSL report is received from the FSL Laboratory. Learned APP also submitted that the IO shall make all the endeavours that the FSL report is received from the FSL Laboratory at the earliest. Thereafter, the supplementary charge-sheet may or may not be filed.

Learned counsel for the petitioner, in view of the submission of the learned APP, seeks permission to withdraw the petition, with liberty to file a petition, if required as per law, after completion of the investigation.

Accordingly, the petition is dismissed as withdrawn, with liberty as prayed. Pending application is also dismissed. CHANDER SHEKHAR, J MAY 27, 2019 tp
