O R D E R

The present petition has been filed seeking following relief: "(a) Set aside the condition "it is directed that applicant/accused shall not leave the country without prior permission of ld. Trial court and shall deposit his passport with trial court within one week of his release" imposed by the Court of Ld. Addl. Sessions Judge, Special Court (Electricity) South West, Dwarka Courts, Delhi in Bail Application No. 423/2020 vide order dated 28.01.2020, in FIR bearing No.

204/2019 U/s 420/406/468/471/201/34/120B IPC P.S. Janakpuri, in the fact and circumstances of the case and in the interest of justice."

The learned counsel for the petitioner submits that the petitioner was granted bail vide order dated 28.01.2022 passed by the Additional Sessions The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Judge, Dwarka Court, Delhi subject to the condition that the petitioner shall not leave country without prior permission of the learned Trial Court and shall deposit his passport with Trial Court within one week of his release. 3.

The learned counsel submits that the aforesaid condition was complied with inasmuch as the petitioner had duly deposited his passport with the learned Trial Court.

He submits that the investigation in the matter is complete and the chargesheet was filed in the year 2020 but till date the charges have not been framed. According to him, the conclusion of trial is nowhere in sight. 5.

It is further the contention of the learned counsel that the petitioner intends to travel to Dubai alongwith his family for which purpose the permission to travel is required, as well as, his passport needs to be returned. In this backdrop the aforesaid relief has been sought. 6.

The learned APP has handed over the status report in Court, the same is taken on record. He also points out that an application seeking similar relief has been filed by the petitioner before the learned Trial Court. A copy of said application has also been annexed by the petitioner to the present petition.

In view of the bail condition, since the petitioner has been granted liberty by the learned Additional Sessions Judge to seek permission from the learned Trial Court for travelling abroad, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to pursue his aforesaid application before the learned Trial Court. 8.

Accordingly, the petition is dismissed as withdrawn with liberty to the petitioner to pursue his said application before the learned Trial Court. The petitioner is also at liberty to file an application seeking preponement of the date before the learned Trial Court. In the event such an application is filed, the learned Trial Court may consider the same in the light of urgency articulated in said application. 10.

The petition stands disposed of.
