The Petitioner was dismissed from service after Departmental Enquiry on 08.05.2018. Appeal, revision and representation filed by the Petitioner were dismissed on 20.12.2018, 27.06.2019 and 04.12.2020 respectively.

If the Petitioner was to file a suit for challenging his dismissal in the year 2026, the same would have been dismissed for having been filed beyond the period of limitation.

Learned counsel representing the Petitioner submits that the Petitioner filed W.P.(C) 44/2026 before the Hon'ble Supreme Court which was permitted to be withdrawn with liberty to approach the jurisdictional High Court.

The Writ Petition before the Hon'ble Supreme Court was also filed in the year 2026. Even if the Petitioner is to claim the benefit of exclusion of period for filing the Writ Petition in the Hon'ble Supreme Court, the present petition still suffers from unexplained delay and latches.

Hence, the present dismissed is dismissed on the ground of laches. Pending applications also stand dismissed. 8.
The objection raised on behalf of the Respondents in relation to territorial jurisdiction is left open.
