By way of the present petition, the petitioner seeks quashing of the FIR bearing No. 435/2017, registered at Police Station Saket, New Delhi for the commission of offence punishable under Sections 420/468/471/120B of the Indian Penal Code, 1860 (hereafter 'IPC') and proceedings emanating therefrom.

The petitioner is present before this Court and has been identified by his counsel and concerned Investigating Officer (IO) from Police Station Saket, New Delhi.

This Court notes that respondent no. 2 was present on 09.03.2026 and her statement was recorded that she has no objection, in case the FIR is quashed as she has received the entire amount from the petitioner. identified by the concerned Investigating Officer. 4.

Briefly stated, facts of the present case are that petitioner had committed criminal trespass in the property of respondent no. 2 bearing No. A-24, Third Floor, Sun Apartment, Indira Enclave, Neb Saria, New Delhi110068, upon which respondent no. 2 had filed complaints culminated into the present FIR. During pendency of the case, both the parties had jointly entered into the Memorandum of Understanding dated 05.03.2024, entered between them.

In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 6.

Accordingly, FIR bearing No. 435/2017, registered at Police Station Saket, New Delhi for the commission of offence punishable under Sections 420/468/471/120B of IPC and all consequential proceedings emanating therefrom are quashed.

In view of the above, the present petition stands disposed of. 8.
