The application stands disposed of accordingly. W.P.(CRL) 1595/2019 The instant petition under Article 226 of the Constitution of India read with Section 482 of Code of Criminal Procedure, 1973 (Cr. P.C) has been filed seeking release of the petitioner on parole for the period of two months on the ground that petitioner wishes to sell his property to fulfil his responsibility as father and arrange some money for his family members because he is the only bread earner in the family and also to maintain social ties with family relations.
Status report has been filed.
The above averments have been verified by the Station House Officer, Police Station: Sadar Bazar, Delhi.
Learned Additional Standing Counsel (Criminal) states that she has no objection in granting parole to the petitioner. Heard.
In the interest of justice, the petitioner is directed to be released on parole for a further period of 30 days from the date of his release on his executing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent, subject to the following conditions:
i) The petitioner shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working conditions at all times. The same shall not be changed without prior intimation to the Jail Superintendent; ii) The petitioner shall report at the local police station to mark his attendance on every alternate day at 11:00 a.m. during the period of parole;
iii) The petitioner shall duly surrender at the end of the period of parole; and iv) The petitioner shall also not indulge in any criminal activity while on parole.
A copy of this order be communicated to the Jail Superintendent. The petition stands disposed of accordingly.
