The petitioner has approached this Court under Article 226 of the Constitution of India, with regard to an application for compassionate appointment in respondent No. 2 - Inland Waterways Authority of India. It is contended that the petitioner's father passed away in the year 2014 while he was in the service of respondent no. 2 as a Staff Car Driver. 2.

The petitioner thereafter applied for compassionate appointment in the year 2014 and was informed that his name had been registered and would be considered for future vacancies. Further documents were sought from the petitioner in the year 2022, which he submitted. 3.

respondent No. 2. For the present, the relief sought by the petitioner is only that the status of his application be communicated to him, and for respondent No. 2 to confirm that he remains in the queue. 4.

Pursuant to the order dated 30.04.2025, learned counsel for respondent No. 2 enters appearance and submits, upon instructions, that respondent No. 2 maintains a waiting list of candidates for compassionate appointment, in which the petitioner presently stands at serial No. 16. She states that he will be considered in the order of priority, subject to the availability of vacancies in the appropriate grade, within the 5% limit for compassionate appointments. She states that compassionate appointments are made, in terms of the Department of Personnel & Training Scheme (updated on 20.08.2022) ["Scheme"], which is annexed at Annexure P-1 to the writ petition.

The writ petition is disposed of in terms of the above submissions of respondent No. 2, and with the direction that, within a period of two weeks from today, respondent No. 2 will communicate to the petitioner the status of his application and the waiting list, as it stands. 6.
