The present application has been filed on behalf of the petitioner for withdrawal of the present writ petition.

As per the petitioner, the respondent no. 2-Municipal Corporation of Delhi ("MCD") has already booked the unauthorized construction in the property in question, and has commenced action with regard thereto. Thus, learned counsel for the petitioner submits that the inconvenience to the easement any rights of the petitioner, caused by the illegal construction has been cleared, thereby, leaving the petitioner with no other grievance or cause of action.

Learned counsel for the MCD submits that they do not have any objection if the present petition is withdrawn. 4.

Binding the MCD to take requisite action against any unauthorized construction in the property in question, the present writ petition is dismissed as withdrawn, along with the pending application. 5.

The next date of hearing of 29th October, 2025 stands cancelled.
