The present petition has been filed under Article 226 of the Constitution of India seeking following relief: [a] Issue a writ of certiorari and quash the withdrawal order dated 07.09.2020 passed by the Respondent No.2 vide which the recognition of the Petitioner for B.Ed. Course has been withdrawn; and [b] Issue a writ of mandamus and direct the Respondent No.2 to issue restoration order in favour of the Petitioner for B.Ed course expeditiously and in a time bound manner; and 4.

Mr. Akhilesh K. Srivastava, the learned Standing Counsel for the respondents at the outset submits that against the impugned order The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. withdrawing recognition, the remedy of appeal is available under Section 18 of the NCTE Act, 1993, therefore, the present petition is not maintainable on account of an alternative efficacious statutory remedy being available. 5.

Faced with this situation, Mr. Rishabh Kumar the learned counsel for the petitioner college seeks to withdraw the present petition with liberty to prefer an appeal before the learned Appellate Authority in terms of the statutory provisions.

Accordingly, the petition is dismissed as withdrawn with liberty as aforesaid.

Needless to say that the petitioner college shall be at liberty to avail the remedies available to it in the event the learned Appellate Authority decides against the petitioner.
