In view of the decision of the NHAI to withdraw the Circular No. NHAI/EW-II/ADB/BOT/2007/15, dated 28th August, 2020, issued to the petitioner, the cause of action in this petition does not survive for adjudication.

Mr. Jeevesh Nagrath, learned counsel appearing for the petitioner, also acknowledges that nothing survives in the matter for adjudication as the principal grievance in the petition was against the Circular No. NHAI/EW-II/ADB/BOT/2007/15, dated 28th August, 2020, which stands withdrawn.

Accordingly, he seeks leave to withdraw the petition. 4.

In view of the above submissions, this petition is dismissed as withdrawn.
