IA No.3387/2017 This is an application filed on behalf of the petitioner to transfer the present petition to the City Civil Court at Sambalpur, Odisha. It is seen that the present petition is for enforcement of an arbitral award and, therefore, the petitioner would be entitled to file an appropriate application for enforcement of the award where the respondents reside or where the property of the respondents is located [See : Daelim Indistrial Co. Ltd.

v.

Numaligarh Refinery Ltd.:

2009(3) ArbLR (Delhi)].

Accordingly, the present application is disposed of with liberty to the petitioner to file an appropriate application for enforcement of the arbitral award before the concerned Court.

OMP (ENF.) (COMM.) 39/2017 In view of the above, the petitioner seeks to withdraw the present petition to file the same before the appropriate court. The petition is disposed of with the aforesaid liberty.
