% 07.02.2017 By this petition, petitioner seeks quashing of FIR No. 527/2016 u/s 379 IPC registered at PS Mianwali Nagar.
Respondent no.2 / complainant is represented through his Attorney Mr. Vishal Nagar, Advocate who is present in court. Copy of Power of Attorney has been placed on record. It is submitted that matter stands amicably settled between the parties and the respondent no.2 has sent an email stating therein that he has authorised his Attorney to settle the matter upon receipt of sum of `58,000/- from the petitioner. Investigating Officer admits that he has received the copy of email and the Power of Attorney. Mr. Vishal Nagar, Advocate submits that, in view of the receipt of the settled amount, the complainant / respondent no.2 has no objection if the FIR
is quashed.
In view of the settlement arrived at between the parties, in my view, no fruitful purpose would be served by continuing the present criminal proceedings. Accordingly, in the interest of justice FIR No. 527/2016 u/s 379 IPC registered at PS Mianwali Nagar and the consequent proceedings emanating therefrom are quashed. Miscellaneous applications are disposed of as infructuous. Dasti.
