A Petition under Article 226 of Constitution of India read with Section 482 Cr.P.C/528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of FIR No.695/2022 under Section 323/341/506/509/195A IPC registered at Police Station Jyoti Nagar, Delhi in terms of the MOU dated 25.01.2025.

Brief facts of the case are that the marriage was solemnized between petitioner No. 1 and respondent No. 2 on 03.12.2014 according to Hindu rites and ceremonies. It is stated that a female child Aashvi was born out of the said wedlock on 11.12.2016. Due to some temperamental differences, the Respondent No.2 started residing separately from Petitioner No.1 since 04.01.2020.

It is further submitted that on the Complaint of respondent No. 2, an FIR bearing No. 695/2022 under Sections 323/341/506/509/195A IPC of the Indian Penal Code, 1860 got registered at Police Station Jyoti Nagar. 4.
It is stated that the Chargesheet was filed in the Court and during the pendency of the case, the matter has been amicably settled between the petitioners and Respondent No.2 vide Compromise Deed dated 25.01.2025, whereby Petitioner No.1 and Respondent No.2 have decided to reconcile their marriage and to live together as husband and wife. 5.
In view of the Compromise Deed dated 25.01.2025, the present petition has been filed.

The parties are present before this Court in-person today, and have been identified by their respective counsels and Investigating Officer concerned. It is submitted that the said FIR is an outcome of the matrimonial disputes between the Petitioner and the Complainant/Respondent. The matter has been amicably settled without any fear, force or coercion between the parties. It is also been agreed that the other FIRs inter-se the parties shall also be quashing. The statement of the parties have already been recorded before the learned Joint Registrar on 01.05.2025. 7.
The respondent No. 2/wife submits that she has been livingly in her matrimonial home peacefully after reconciling all the issues with the Petitioners. Today, the complainant/respondent No. 2/wife, who is present states that she has no objection if the FIR is quashed. 8.
In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is a family matter, I am of the opinion that no useful purpose will be served in continuing with the proceedings, rather the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing No.695/2022 registered at Police Station Jyoti Nagar, for offences punishable under Sections 323/341/506/509/195A IPC and all consequential proceedings emanating therefrom are quashed. 11.
