Learned counsel appearing on behalf of the petitioner submitted that vide order dated 5th February, 2024, suit bearing no. Misc. SCJ 107/24, was dismissed for non-prosecution and vide order dated 13th September, 2024, the restoration application was also dismissed for non-prosecution by the learned Trial Court.

It is submitted that in light of the said orders, the instant matter may be disposed of.

Learned counsel appearing on behalf of the respondents has no objection to the submissions made by the learned counsel for the petitioner. 4.
