O R D E R

% 24.05.2017 Respondent No.1 is a proforma party.

Vide the petition, the petitioner has assailed the impugned award dated 6.11.2000 in I.D. No. 208/1990 passed by learned Presiding Officer, Labour Court No.III, Karkardooma Court, Delhi whereby the termination of the services of the respondent No.2/workman Shri Mahinder by the management of the New Delhi Municipal Council, the petitioner herein has been held to be not justified and further vide the impugned award the workman had been held entitled to reinstatement into service but without any back wages and the period from the date of his termination of the services till the enforcement of the award was directed to be treated as having spent not on duty. It has, however, been brought to the notice of the Court on 23.5.2017 and now today by learned counsel for the petitioner through the record produced by the petitioner that the respondent No.2 has

already been superannuated on 5.2.2015 having attained the age of sixty years. In view thereof it is apparent that the petition has become infructuous and calls for no further action.

The petition stands disposed of accordingly.

A copy of the noting dated 11.6.2015 of the records of the petitioner be placed on record.
