The present petition filed under Section 528 of the BNSS seeks quashing of the FIR No. 187/2019, under Sections 323/354/452/34 of the IPC, registered at P.S. Lahori Gate, and all other consequential proceedings emanating therefrom, including the chargesheet filed and pending before the Court of Ms. Manya, learned JMFC, Central District, Tis Hazari Courts, New Delhi.

Learned counsel appearing on behalf of the petitioner submits that the present FIR was registered on 07.09.2019, on account of some property dispute between the latter and respondent no. 2. parties have now orally settled their disputes and a third party has bought their respective shares in the said property. Learned counsel for the petitioner further submits that the present petitioner has since compromised his disputes with respondent no. 2. He further submits that the compromise has been arrived at between the parties. Therefore, the present petition seeking quashing of FIR No. 187/2019, under Sections 323/354/452/34 of the IPC, registered at P.S. Lahori Gate, and all the other consequential proceedings emanating therefrom has been preferred.

It is submitted that the petitioners and the respondent herein are neighbours and the incident was related to a minor dispute resulting in the registration of present FIR.

Copy of the Certificate of Settlement dated 09.04.2025, has been placed on record, which records the verbal/oral settlement between the parties and their agreement to cooperate with each other in quashing of the FIR. 7.
The petitioner and respondent no. 2 are present in person before the Court and have been duly identified by their respective counsels, as well as the Investigating Officer, SI Kavish Rana, PS Lahori Gate, Delhi. 8.
The Complainant/respondent No.2 states that the matter has been settled with the petitioners and she has no objection if the FIR is quashed against the petitioners.

Learned APP for the State submits that the chargesheet has been filed is pending before the Court of competent jurisdiction however, in view of the settlement between the parties, he has also no objection, if the present FIR and the consequent chargesheet pending before the Court of competent jurisdiction is quashed.

Supreme Court has recognized the need of amicable resolution of disputes by observing as under:- "61. ... In other words, the High Court must consider whether it would be unfair or contrary to the interest of justice to continue with the criminal proceedings or continuation of criminal proceedings would tantamount to abuse of process of law despite settlement and compromise between the victim and the wrongdoer and whether to secure the ends of justice, it is appropriate that criminal case is put to an end and if the answer to the above question(s) is in the affirmative, the High Court shall be well within its jurisdiction to quash the criminal proceeding."

In view of the aforesaid circumstances, and that fact that the parties have put a quietus to the dispute, no useful purpose will be served in continuing with the FIR No. 187/2019, under Sections 323/354/452/34 of the IPC, registered at P.S. Lahori Gate, and all other consequential proceedings emanating therefrom, including the chargesheet filed and pending before the Court of Ms. Manya, learned JMFC, Central District, Tis Hazari Courts, New Delhi.

In the interest of justice, the petition is allowed, and the FIR No. 187/2019, under Sections 323/354/452/34 of the IPC, registered at P.S. Lahori Gate, and all other consequential proceedings emanating therefrom, including the chargesheet filed and pending before the Court of Ms. Manya, learned JMFC, Central District, Tis Hazari Courts, New Delhi, is hereby quashed. 13.
The Petition is allowed and disposed of accordingly. 14.
