% 12.12.2019 This appeal is against the judgment and decree dated 20.09.2018 in suit No.11154/2016 passed by the learned Trial Court. During the course of pendency of appeal, the parties have settled their disputes vide settlement agreement dated 07.11.2019 arrived at before Delhi High Court Mediation Centre, New Delhi. The terms of settlement are enumerated in para No.9(i) to 9(ix). Both learned counsels say the compromise so arrived at between the parties was voluntarily and without any undue influence from any corner. The compromise being lawful is taken on record. The copy of settlement agreement be placed on record within three days from today. The parties shall be bound by the terms of settlement agreement dated 07.11.2019.

The appeal stands disposed of in terms of settlement agreement dated 07.11.2019. The pending application(s), if any, also stands

disposed of.

As the matter has been settled through mediation, the appellant shall be entitled to refund of Court per Section 16A of the Court Fees Act. No order as to costs.
