1. Learned counsel for the Petitioner states that at this stage the Petitioner only seeking the provisional release of unbranded items and the petitioner is laying no claim to any of the branded items that may have been seized.

2. Learned counsel for the Respondent states that a show cause notice has been issued to the Petitioner and a reply is awaited.

3. It is directed that the Petitioner will within the next three days make a detailed representation to the Commissioner of Customs (Exports) seeking provisional release of the unbranded items seized. If such a representation is made within the next three days, it will be dealt with by the Commissioner of Customs (Exports) and an order passed thereon within a period of six weeks thereafter after affording the Petitioner an opportunity of being heard. The decision be communicated to the Petitioner by the same period. If W.P.(C) 760/2016

aggrieved by such decision, it will be open for the Petitioner to avail of the remedies that may be available to the Petitioner in accordance with law.

4. The petition is disposed of in the above terms.
