A Writ Petition under Article 226 Constitution of India read with Section 528 of BNSS has been field for seeking Parole of 12 weeks in case FIR No.247/2003 under Section 376(2)(G)/366/394 IPC registered at Police Station Chankya Puri.

It is submitted that the Petitioner's wife has developed serious health concern and is diagnosed with Adenomyosis and further with bacterial vagianosis requiring surgical intervention. Her surgery for uterus removal has been scheduled for 02.05.2025. A prayer is, therefore, made that he be granted Parole for 12 weeks.

to move an Application for release on Parole before the Jail Authorities on account of the urgency of getting the Parole and hence, the Parole is sought for 12 weeks.

Learned ASC for State has submitted a detailed Report, wherein it is stated that the medical condition of the wife of the Petitioner stands verified. The Status Report be taken on record.

Submissions heard and record perused.

Considering the extreme urgency of being released on Bail on account of medical condition of his wife, the Petitioner is granted Parole for a period of four weeks, on the following terms and conditions: - i.

The Petitioner shall furnish a personal bond in the sum of Rs.10,000/- with one surety of the like amount, to the satisfaction of the Jail Superintendent.

ii. The Petitioner shall report to the SHO of the local area once a week on every Sunday between 10:00 AM to 11:00 AM during the period of Parole.

iii. The Petitioner shall furnish a telephone/mobile number to the Jail Superintendent as well as SHO of local police station, on which he can he contacted, if required. The said telephone number shall be kept active and operational at all the times by the Petitioner. iv.

The Petitioner shall ordinarily reside at the address mentioned in the Petition.

v.

Immediately upon the expiry of period of Parole, the Petitioner shall surrender before the Jail Superintendent. vi. The period of Parole shall be counted from the day when the Petitioner is released from jail.
