This is a petition filed under Section 11 of the Arbitration & Conciliation Act, 1996 for appointment of an Arbitrator. 2.

The relevant clause relating to arbitration is Clause 32 at page No.68. The arbitration clause was invoked by the petitioner on 23rd January, 2019. As no reply was given by the respondent, the petitioner has filed this petition.

Mr.Rajeev Sharma, learned counsel appearing on behalf of the respondent has given his consent for appointment of an Arbitrator. Accordingly, this Court appoints Justice Ajit Bharihoke, a retired Judge, of this Court (Mob. No. 9650110057), as the sole arbitrator. 4.

The appointment of the Arbitrator shall be regulated by the Rules of DIAC.

Let a copy of this order be sent to Justice Ajit Bharihoke (Retd.). The parties shall be at liberty to appear before the learned Arbitrator after taking prior appointment on the mobile number.

Petition is disposed of.
