After addressing some arguments, the learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file an appropriate application before the learned Trial Court as there are errors apparent on the face of the impugned order and some corrections in the impugned order are to be made.

The learned counsel refers to para 10 of the impugned order wherein the legal heirs of the plaintiffs have been allowed to be taken on record. Moreover, in para 11 the issues have not yet been framed, however, the case has been listed for petitioner‟s evidence. Additionally, there are certain other errors referred in the impugned order.

Learned counsel submits that on the last date of hearing, he did not appear before this Court to submit that his mother was hospitalized whereas, his mother is no more and it appears that due to some confusion some advocate has entered appearance on his behalf. 4.
The learned counsel further seeks liberty to file fresh petition if needed.

Permission granted to withdraw with liberty as prayed for. 6.
Accordingly, the present petition along with the pending application stands disposed of.
