EX. APPL(OS) 1867/2025 (on behalf of the Decree Holder for correction / modification of the judgment dated 28.08.2025) 1.
This is an application seeking correction/modification of a typographical error in the judgment dated 28.08.2025. Paragraph 47 of the said judgment reads as under:- "47. In the aforesaid conspectus, considering the judgment rendered by this Court in OMP (COMM) 57/2022, (i) stay imposed vide orders dated 17.01.2022 and 25.11.2022 is vacated; (ii) the registry is directed to release the Fixed Deposit amount [deposited as a pre-condition of staying the impugned arbitral award in terms of orders dated 17.01.2022 and 25.11.2022 in OMP (COMM) 57/2022] in favor of Karan Cab Services Pvt. Ltd."

It is pointed out that, since the petition under Section 34 of the Arbitration and Conciliation Act, 1994 has been dismissed, the Fixed Deposit amount is to be released in favour of the decree holder/applicant. However, there is a typographical error in this count in the afore-quoted paragraph 47 of the judgment.

Accordingly, the application is allowed; Paragraph 47 of the judgment would read as under:
"In the aforesaid conspectus, considering the judgment rendered by this Court in OMP (COMM) 57/2022, (i) stay imposed vide orders dated 17.01.2022 and 25.11.2022 is vacated; (ii) the registry is directed to release the Fixed Deposit amount [deposited as a pre-condition of staying the impugned arbitral award in terms of orders dated 17.01.2022 and 25.11.2022 in OMP (COMM) 57/2022] in favor of HCL Technologies Ltd."
