The present petition has been filed by the Petitioner seeking quashing of the attachment order dated 26th November, 2015 passed by the Assistant Collector, Section-II & Recovery officer, Office of Registrar of Cooperative Societies, New Delhi, which is based on the award dated 23rd August, 2003 passed by ld. Arbitrator in Arbitration Case No. 10172/AR/2002-03. 3.
According to the Petitioner, the Society - M/s Mayur Bagh Cooperative Group Housing Society Limited (hereinafter 'Society') did not have proper management for several years and hence, this attachment order dated 26th November, 2015 is being challenged belatedly. As per the ld. Counsel for Petitioner, the Petitioner has already been issued a due certificate on 12th June, 2024.

Ld. Counsel for the Society, on the other hand, submits that there are no outstanding demands against the Petitioner's flat. A perusal of the impugned order would show that the same is passed on the basis of the premise that there are outstanding dues of the Petitioner towards the Society. However, as of 2024, all outstandings appear to have been cleared. In view thereof, the impugned attachment order dated 26th November, 2015 is quashed and set aside.

The petition is disposed of in these terms. All pending applications are also disposed of.
