BAIL APPLN. 230/2016 1.
Present petition under Section 439 of the Cr PC has been filed by the petitioner for seeking bail in case FIR No.343/2015 registered at police station Gulabi Bagh, Delhi for the offences punishable under Sections 392/34 of the IPC.

The allegations against the petitioner are that on 20.12.2015 he along with other co accused persons robbed a mobile phone with an amount of Rs.110/- pertaining to the complainant. The petitioner was nabbed at the spot and recovery of an amount of Rs.50/- effected from his possession.

As stated by learned Prosecutor that investigation is almost complete and Prosecution is in the process of filing of the chargeBAIL APPLN. 230/2016

Admittedly, the petitioner is in custody from 21.12.2015 and he is no more required for the purpose of investigation in this case. 5.
Keeping in view the young age of petitioner and the fact that he has no criminal antecedents and completed almost one month in custody, I am of the view that he should be released from prison. 6.
Consequently, the applicant shall be released on his furnishing a personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of learned Trial Court with the directions that in case of any change of address of applicant or surety, the same shall be communicated to the jail authorities, learned Trial Court as well as IO/SHO concerned.

In above terms, instant petition is allowed.
