After some hearing, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to avail legal recourse to claim damages/ rent for the respondent's occupation of the property beyond the period envisaged in the order dated 13.09.2023 passed in RFA No. 686/2023.

Accordingly, the petition is dismissed as withdrawn with liberty as prayed for.
