The petitioner had filed a suit seeking recovery of possession and damages and was aggrieved by order dated 23.03.2023 whereby his application moved under Order XV-A CPC had been dismissed. 2.

Petitioner however, submits that the matter has already been amicably settled between the parties and petitioner/plaintiff has sold suit property to the defendants and has already withdrawn the suit in question. 3.

He submits that, therefore, no further action is warranted in the present petition.

Learned counsel for respondent appears through video-conferencing and confirms the abovesaid subsequent development. 5.

In view of the subsequent development and the facts that the suit in question has already been withdrawn by the petitioner/plaintiff, nothing survives in the present petition and, therefore, the present petition is disposed of as having become infructuous.
