W.P.(C) 6662/2020 & CM APPL. 23173/2020 Admittedly, the petitioners have filed a Civil Suit, being Suit No. 181/2020 titled Raghubir Singh and ors. vs. South Delhi Municipal Corporation & Ors., which is pending adjudication before the Court of the learned Senior Civil Judge, South East District, Saket Courts, New Delhi. The Suit is one claiming declaration, permanent and mandatory injunction. In view of the above and as the dispute raised is one which can best be adjudicated in a Civil Suit, this Court declines to entertain the present petition, granting liberty to the petitioners to approach the concerned Civil Court with a request for an interim relief, incase so adviced. If such application is filed before the learned Civil Court, the same shall be expeditiously considered.

It is made clear that this court has not expressed any opinion on the

merits of the claim made by the petitioners.

The petition is dismissed with the above observation. A copy of this order be supplied to the learned counsel for the petitioners on the e-mail address provided.
