The present writ petition has been filed seeking a direction to the respondent-MCD to take action against the unauthorized construction being carried out at F-11/750, Ganesh Nagar-II, Shakarpur, Delhi-110092 ('subject property').

It is the case of the petitioner that the construction is being carried out without any sanction plan.

Counsel appearing on behalf of the respondent-MCD and the counsel appearing for owner/occupier of the subject property submit that the construction is being carried out pursuant to a valid sanction plan. 3.1.
