A Coordinate Bench of this Court by its judgment dated 31.05.2024 upheld the Impugned Award dated 24.03.2021 passed by the learned Labour Court. The relevant extract of the said judgment is set out below: "61. Accordingly, it is held that the learned Labour Court rightly adjudicated upon issue no. ii in holding that the services of the workman were terminated illegally by the respondent management.

62. In view of the aforesaid discussions, this Court is of the view that the respondent is entitled to reinstatement, along with all consequential benefits and allowed the cost of litigation to the respondent workman since the matter is pending since 2017.

63. In light of the aforesaid discussions, it is held that the impugned award passed by the learned Labour Court dated 24th March, 2021 passed by the Presiding Officer, Labour Court, Rouse Avenue, New Delhi is upheld and the instant petition is dismissed."

The record reflects that the judgment dated 31.05.2024 was challenged by the Petitioner by way of a Special Leave Petition (Civil) No. 20951/2024 and on 03.10.2024, the Petitioner withdrew the same with liberty to approach this Court by filing a LPA against the judgment dated The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Respondent submits that he has not received any notice from the Court about the pendency of an Appeal.

Given the fact that the Impugned Award was upheld by a Coordinate Bench of this Court by its judgment dated 31.05.2024 and given the lapse of sufficient time, this Court deems it apposite to direct the Registry of this Court to release the interest amount of Rs. 85,791/- in favour of the Respondent.
