This matter has been placed before Court pursuant to communication dated 25.04.2024 received from learned Principal District & Sessions Judge (Officiating), Patiala House Courts, New Delhi in case No. 42856/2016 titled "State vs. Arvind Gaur & Ors." in FIR No. 211/2011 registered under Section 188 IPC at PS: Connaught Place. On 15.04.2024, learned MM-01, PHC, NDD directed that the matter be placed before the learned Principal District and Sessions Judge in light of the mandate regarding constitution of Special Courts concerning matters involving sitting or former MPs/MLAs. Based on this, learned Principal District and Sessions Judge passed the following order on 19.04.2024:- ''Perused the order dated 15.04.2024 of Sh. Yashdeep Chahal, Ld. MMOI, PHC, NDD wherein it is mentioned that one of the accused i.e. Swati Maliwal has been a Member of Parliament. The courts dealing with the cases pertaining to MP/MLAs is at Rouse Avenue Courts. The power of Inter-District transfer of the cases is vested in the Hon'ble High Court of Delhi.
In view of the above, the present case file be sent to the Ld. Registrar General, Hon'ble High Court of Delhi, New Delhi ... ... In view of the aforesaid two orders and the mandate regarding constitution of Special Courts concerning matters involving sitting or former MPs/MLAs, the case titled "State v. Arvind Gaur and Ors" in FIR No. 21/2011 registered at PS: Connaught Place, is transferred to Rouse Avenue Courts. The matter will be listed before the learned Principal District and Sessions Judge, Rouse Avenue Courts, Delhi on 28.05.2024 for passing appropriate orders, with advance intimation to the concerned parties. 3.
Copy of this order shall be sent to both the Courts for information and necessary compliance.
