The petitioner has filed the present petition, inter alia, praying that FIR No.0051/2019 under Section 3(1)(ix) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 registered with PS Delhi Cantt be quashed.

The petitioner contends that the said FIR had been instituted on a complaint that is bereft of any details. He submits that no specific incident of commission of the alleged offence had been recorded; nonetheless, the FIR has been filed on a general complaint being made by the complainant. It is also submitted that all person, who are supporting the complainant are members of the staff of Rajputana Rifles Heroes Memorial Senior Secondary School, Delhi Cantt, Delhi-110010. The petitioner states that the complaint is a vexatious complaint and was filed only because the petitioner had recommended disciplinary action against certain members of the staff.

Ms Kapoor, learned ASC appearing for the State submits that a charge-sheet has already been filed and the trial court is required to examine the contents of the same. If it finds that the material does not lead to a strong suspicion of commission of the alleged offence, the petitioner would be discharged.

At this stage, Mr Bhardwaj, learned counsel appearing for the petitioner seeks to withdraw the present petition with liberty to urge all contentions before the Trial Court.
