The present petition is filed challenging the order dated 19.05.2023, whereby the charges were framed against petitioner under Section 376(3) of the Indian Penal Code, 1860 and Section 6 [as defined Section 5(j)(ii) of the Protection of Children from Sexual Offences Act] (POCSO Act).

The learned Additional Public Prosecutor for the State, on instructions, submits that the trial had since proceeded and by a judgment dated 24.05.2024, the petitioner has been acquitted of the said charges.

In view of the above, the present petition is disposed of having become infructuous.

The petitioner is at liberty to revive the present petition in case the appeal is filed challenging the order of acquittal. AMIT MAHAJAN, J MAY 27, 2024/"SK"
