WP(C) 6721/2020 & CM 23343/2020 The learned counsel for the petitioner submits that the case of the petitioner is covered by the judgment dated 04.11.2019 of this Court passed in W.P.(C) 9088/2018, titled Mukut Pathak & Ors. v. Union of India & Anr. The learned counsel for the respondent nos.1 and 2, who appears on advance notice, submits that even if the relief is granted to the petitioner in terms of that judgment, it would not entitle the petitioner to avail the benefit of the Companies Fresh Start Scheme, 2020 declared by the respondent no.1 vide Circular dated 30.03.2020.

This Court without expressing any opinion on whether the petitioner is entitled to avail of the benefit of the said Scheme, disposes of the present petition in terms of the law laid down by this Court in its above referred judgment dated

04.11.2019 passed in W.P.(C) 9088/2018, titled Mukut Pathak & Ors. v. Union of India & Anr.
