The present writ petition has been filed seeking a direction to the respondents no.1 and 2 to take action against unauthorised construction being carried out at property no.T-933, Bagh Raoji Kishan Gang, New Delhi.

It is alleged that the construction is taking place without any sanctioned plan and the respondent no.3 has constructed floors far in excess of what is permissible under the building bye-laws. 4.

notice submits that the construction is being carried out pursuant to a valid sanctioned plan.

In view thereof, this Court does not find any merit in the present writ petition and the same is dismissed.

Needless to state, the respondent/MCD shall ensure that the construction is carried out strictly in terms of the sanctioned plan. In the event there are any deviations, appropriate action shall be taken in accordance with law.
