The admitted position is that the complainant's examination has not yet been completed. Mr. Manjeet Singh, learned counsel for the applicant, points out that there were two other injured victims, of whom the prosecution has stated that it would not be possible to examine one, due to his medical condition (dysphasia/age). However, after some arguments, Mr. Singh seeks permission to withdraw the present application, with liberty to approach the learned Sessions Court again at the appropriate stage.
4.
It is made clear that the Sessions Court may consider such a request on its own merits, including in the event of any inordinate delay in the examination of the complainant or other witnesses. 5.
The bail application, along with the pending application, is dismissed as withdrawn in terms of the aforesaid submissions. 6.
It is clarified that this Court has not made any observation on the merits of the case, and all rights and contentions of the parties in any future application are left open.
