By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with FIR No. 103/2025 dated 24.09.2025, lodged at Police Station Tilak Marg, New Delhi, under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023.

This is the second bail application filed by the applicant before this Court in the same proceedings. The earlier application [BAIL APPLN. 709/2026] was disposed of on 20.04.2026, with the following order : "1. By way of the present application, the applicant seeks regular bail in connection with FIR No. 103/2025 dated 24.09.2025, registered at Police Station Tilak Marg, New Delhi, under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023.
2. Mr. Hitesh Vali, learned Additional Public Prosecutor for the State, has handed over a copy of the status report dated 24.02.2026 in Court, which is taken on record.
3. After some arguments, Mr. Nitin Kumar, learned counsel for the applicant, seeks permission to withdraw the present bail application, without prejudice to the applicant's right to approach the Sessions Court at the appropriate stage, including after the recording of BAIL APPLN. 2109/2026 Page 1 of 2 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. evidence of material witnesses.
4. The bail application is dismissed as withdrawn in terms of the above submission.
5. The prosecution shall ensure that no unnecessary adjournments are sought before the learned Trial Court.
6. It is clarified that this Court has not expressed any opinion on the merits of the case or on any application that may be moved before the learned Sessions Court, which shall be considered independently, in accordance with law."

The applicant thereafter approached the Sessions Court again for bail, which was dismissed by order dated 19.05.2026, noting inter alia that the public witnesses [PW-1 and PW-2] had only been partially examined, and their examination was yet to be concluded. The aforesaid position is undisputed.

After some arguments, Mr. Nitin Kumar, learned counsel for the applicant, seeks permission to withdraw this bail application, with liberty to the applicant to approach the Sessions Court at the appropriate stage. 5.
The bail application, alongwith pending application, is dismissed as withdrawn in terms of the above submission. 6.
It is made clear that this Court has not made any comment on the merits of the case or on any proposed application before the Sessions Court, which may be considered by the Sessions Court in accordance with law.
