The present petition is filed under Article 226 of the Constitution to impugn the order dated 18.09.2020 issued under the signature of respondent no. 1 in respect of the land measuring 02 bighas and 02 biswas bearing khasra no. 29/16 min (West) situated in the village Kapashera. 6.

The counsel for the petitioner stated that the petitioner has also filed a revision petition before the Financial Commissioner in respect of the land, subject matter of the present petition and the said revision petition has already been dismissed by the Financial Commissioner vide order dated 06.02.2024 passed in case no. 318/2007 titled as R.N. Sahni V M/s Ratna Apartments Pvt. Ltd. & Ors.

another writ petition bearing no. 4931/2024 wherein vide order dated 04.04.2024, a Coordinate Bench of this Court has directed the concerned authority including the respondents not to take any coercive steps regarding the built up property of the petitioner on the land, the subject matter of the present petition. The counsel for the petitioner further stated that the issue involved in the present petition can be well addressed in the petition bearing no. 4931/2024 which is now listed for hearing on 22.08.2024. In these circumstances, the counsel for the petitioner on instructions seeks permission to withdraw the present petition.

The present petition along with the pending application is allowed to be dismissed as withdrawn.
